Terms of Service

1. Acceptance of Terms

By accessing and using TourCraft ("the Service"), you agree to be bound by these Terms of Service. The Service is provided by IT Genie (Pty) Ltd, a company registered in South Africa.

2. Service Description

TourCraft is a software-as-a-service platform that enables you to create interactive product tours and onboarding experiences for your web applications.

3. Account Responsibilities

  • You are responsible for maintaining the security of your account.
  • You must provide accurate registration information.
  • You are responsible for all activity under your account.

4. Usage Limits

Your subscription plan determines your monthly tour view limit. If you exceed your limit, you will be notified and may need to upgrade your plan.

5. Payment Terms

  • All prices are listed in South African Rand (ZAR).
  • Payments are processed via PayFast.
  • Subscriptions are billed monthly or annually in advance, as selected at checkout.
  • You may cancel your subscription at any time from your dashboard.
  • If applicable, VAT is included in the prices displayed. A tax invoice is issued via email at the time of payment.

6. Refunds and Cancellation

We want you to be satisfied with TourCraft. The following refund policy applies to all paid subscriptions:

  • 14-day refund window for new subscribers. If you are not satisfied with the Service, you may request a full refund within 14 days of your first paid charge by emailing support@tourcraft.com.
  • Cancellation. Cancelling your subscription stops future renewals. You retain access until the end of your current paid period; no pro-rata refund is issued for unused time after the 14-day window above has passed.
  • Service outages. If a sustained service outage caused by us prevents you from using TourCraft for more than 24 consecutive hours during a billing period, contact support for a credit equivalent to the affected time.
  • Statutory rights. Nothing in this policy limits your rights under the South African Consumer Protection Act (Act 68 of 2008), including the cooling-off rights that apply where the Service was sold through direct marketing.

7. Your Warranties Regarding End-User Data

When you use TourCraft to display tours to your end-users, you act as the Responsible Party for any personal information collected through those tours and we act as the Operator on your behalf, as those terms are defined in the Protection of Personal Information Act 4 of 2013 ("POPIA"). By using the Service, you warrant and represent that:

  • Children’s personal information (POPIA s34). You will not knowingly use TourCraft to collect or process the personal information of children under the age of 18 without first obtaining verifiable consent from a competent person (typically a parent or legal guardian). If the Service is deployed in any context that may reach children, the obligation to obtain that consent — and to retain proof of it — rests with you, not with us.
  • Special personal information (POPIA s26). You will not use TourCraft to process Special Personal Information as defined in section 26 of POPIA, including information about a data subject’s religious or philosophical beliefs, race or ethnic origin, trade union membership, political persuasion, health or sex life, biometric information, or criminal behaviour. If your tour configuration or step content captures such information, you are solely responsible for obtaining the authorisations required under section 27 of POPIA, and you indemnify us against any resulting claims.
  • Purpose limitation (POPIA s15). Personal information you collect from end-users via TourCraft will be used only for the purpose for which it was collected and disclosed to the end-user at the point of collection. You will not repurpose end-user data captured through the Service for any unrelated activity — including but not limited to selling it to third parties, building profiles for advertising unrelated to your product, or training third-party AI models on the underlying personal information — without obtaining fresh, specific consent from the end-user concerned.

A breach of any of these warranties is a material breach of these Terms and may result in immediate suspension of the Service. You agree to indemnify and hold us harmless against any losses, fines, regulatory penalties, or claims we incur as a result of your breach.

8. Data Ownership

You retain ownership of all tour content you create. We retain the right to use aggregated, anonymised usage data for improving the Service.

9. Limitation of Liability

The Service is provided "as is". We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of Cape Town, Western Cape.
